Online Contract – Subject Matter and Definition

The term "online sales contract" refers to a distance contract—specifically, a legal transaction concerning movable goods and/or services—concluded between a supplier (in this case, the company P.a.m.co. S.a.s., with its registered office at Zona Industriale Manciano 49/L, Castiglion Fiorentino [Arezzo]; VAT and Tax Code 00293240511; share capital of €10,000.00; R.E.A. no. 67961) and a Customer within a distance sales system organized by the supplier, utilizing the "Internet" as the means of distance communication for said contract.

Accordingly, all contracts shall be concluded directly through the Customer's access to the website www.pamco.it, where, by following the indicated procedures, the Customer may finalize the contract to purchase the goods.

The term "Customer" refers to a natural person who purchases goods and services for purposes not directly related to any professional activity they may carry out.

The sales conditions set out below shall remain in effect until such time as P.a.m.co. S.a.s. decides to modify them.

Any changes to these sales conditions shall take effect from the moment they are published on the website www.pamco.it and shall govern sales made from that time onwards.

Prices

Prices are quoted in Euros and do not include VAT.

They are subject to change without notice.

Prices do not include shipping costs.

If the price of an item includes shipping costs, this will be clearly indicated.

Purchasing Methods

Customers may only purchase products listed in the electronic catalog at www.pamco.it.

All specifications listed in the catalog are non-binding and are subject to change without notice.

Orders – Placement

Orders may be placed directly online via the P.a.m.co. S.a.s. website using the shopping cart and associated payment procedures.

Orders – Item Availability

Customers may purchase products listed on the website www.pamco.it subject to current stock levels.

Should an order exceed available stock, the system will accept the purchase only for the items currently in stock and will inform the buyer whether the item will be available in the future and the estimated restocking time. P.a.m.co. S.a.s. reserves the right—in the customer's interest—to verify the quality of items prior to shipment.

If the quality is deemed unsuitable for shipment, P.a.m.co. S.a.s. will not ship the goods and undertakes to refund the amount paid by the customer, including any shipping costs charged.

The customer is required to provide P.a.m.co. S.a.s. with the bank details necessary for the refund, and the supplier is required to issue the refund within 7 working days of receiving said bank details.

Orders – Cancellation

All orders are binding and may be cancelled solely if the goods have not yet been shipped, by means of a written request sent via email. For orders that have already been processed, the customer must exercise their right of withdrawal.

Acceptance of General Terms and Conditions of Sale

The contract entered into between P.a.m.co. S.a.s. and the customer shall be deemed concluded upon acceptance of the order by P.a.m.co. S.a.s. Such acceptance is considered tacit unless otherwise communicated to the customer by any means.

By placing an order via the available methods, the customer declares that they have reviewed all information provided during the purchasing process and fully accept the general terms and conditions and payment terms set out below.

Upon completion of the online purchasing process, the customer shall print or save an electronic copy—and in any case retain—these general terms and conditions of sale, in compliance with Articles 52 and 53 of Legislative Decree no. 206/2005 regarding distance selling.

Shipping – Courier and Delivery Times

Your purchases are generally shipped within two days of payment receipt.

Delivery times are typically around two to four days from the time of shipment.

Shipments are generally handled by New Transport S.a.s., which offers an excellent balance between cost-effectiveness and delivery speed. If necessary, and at its sole discretion, P.a.m.co. S.a.s. reserves the right to ship via a different courier without prior notification to the customer and without increasing shipping costs.

You will receive a tracking number to track your package online directly on the carrier's website.

In any event, P.a.m.co. S.a.s. shall not be held liable for damages resulting from delays in order processing or delivery.

Unless explicitly stated otherwise by our customer service team, delivery is made to street level.

Shipping – Costs

Shipping costs include handling, packaging, and delivery fees.

We recommend consolidating your purchases into a single order. We cannot combine separate orders, and shipping costs will apply to each individual order.

Shipping costs remain payable by the customer, even if the customer exercises their right of withdrawal, or refuses or returns the duly ordered goods to the sender for any reason.

Shipping costs for returning goods to our warehouse are the sole responsibility of the customer. In such cases, the customer is required to reimburse the aforementioned shipping costs; should payment not be made, P.a.m.co. S.a.s. will take the necessary steps to recover the outstanding amount.

Shipping – Receipt of Goods

Upon arrival of the goods, and in the presence of the courier (or postal worker), it is in your best interest to verify the following before signing the delivery note:

- verify that the package is intact, neither damaged nor wet, and otherwise conforms to standard packaging characteristics, including the sealing materials (adhesive tape, twine, metal strapping, etc.);

- check that the number of packages corresponds to the details indicated on the transport document.

Any damage to the packaging and/or the product, or any discrepancy regarding the number of packages or other details, must be immediately disputed by noting a written reservation on the delivery receipt. Failure to provide such notification will result in the items being deemed correctly delivered.

Once the delivery receipt has been signed, the customer may not raise any objections regarding the external condition of the delivered goods.

If the goods are not collected within the maximum holding period due to repeated delivery failures at the address provided by the customer at the time of the order, the shipment will be considered refused and returned to P.a.m.co. S.a.s. warehouses, with the associated costs charged to the customer.

Shipping – What to do in case of transport damage

When the courier delivers the goods, you must always inspect the packaging BEFORE SIGNING the delivery receipt. If the packaging appears damaged, you must do the following:

- accept the package BUT WITH A RESERVATION. That is, sign the delivery receipt but write the following on the document: "ACCEPTED WITH RESERVATION DUE TO DAMAGED PACKAGING";

- once the package is opened, you can check whether the goods are in good condition or have been damaged;

- if the goods are indeed damaged, you must notify us immediately via email, and we will refund the amount you paid;

- if the courier refuses to allow you to accept the goods with a reservation, please reject the delivery, and you will be refunded; if you accept them anyway without noting the reservation in writing on the delivery note, we will not be able to refund you;

- if the damage to the packaging is so severe that it is obvious the goods inside are damaged without even opening the package, you should also refuse delivery in this case, and you will be refunded; we will not be able to refund you if you accept the goods without noting your reservation in writing on the transport document.

Shipping – Liability

The goods are considered delivered the moment they leave the warehouses of P.a.m.co. S.a.s. ...and travels at the buyer's risk, bearing in mind, however, that every single package is covered by insurance against theft or loss during transit up to a maximum of €10,000.00.

We assure you that your purchases will be handled with the utmost care during packaging to ensure the safest possible transport. The packaging used is sized to provide adequate protection for the purchased goods.

Force Majeure

P.a.m.co. S.a.s. assumes no liability for service disruptions caused by force majeure—such as accidents, explosions, fires, strikes, lockouts, floods, earthquakes, and similar events—that prevent the contract from being fulfilled, either wholly or in part, within the agreed timeframe. P.a.m.co. S.a.s. shall not be liable to any party for damages, costs, or losses incurred as a result of the failure to perform the contract for the reasons stated above. In such cases, the customer shall be entitled solely to a refund of the price paid.

P.a.m.co. S.a.s. cannot be held liable for any illicit or fraudulent use by third parties of credit cards, checks, or other payment methods during the payment for items purchased by the customer. At no stage of the purchasing process does P.a.m.co. S.a.s. have access to the customer's credit card number; instead, via a secure connection, the number is transmitted directly to PayPal, the service provider. P.a.m.co. S.a.s. is unable to verify the legitimate origin of the payment instrument used by the customer to pay for the goods.

Buyer's Obligations

Upon completion of the online purchasing procedure, the Customer agrees to print and retain these General Conditions—which they will have already reviewed and accepted, as this is a mandatory step in the purchasing process—as well as the specifications of the item being purchased; this is to fully satisfy the requirements set forth in Articles 3 and 4 of Legislative Decree no. 185/1999.

The Customer is strictly prohibited from entering false, fabricated, or fictitious data when filling out the order form or the registration required to initiate the contract execution process and related communications; personal details and the email address provided must be the Customer's own actual personal data and not those of other individuals or fictitious information.

Registering the same person twice or entering the personal details of other individuals is prohibited. P.a.m.co. S.a.s. reserves the right to take legal action against any such abuse or violation.

Right of Withdrawal

P.a.m.co. S.a.s. grants its customers the right to withdraw from the purchase, in accordance with current legislation (Legislative Decree no. 185 of May 22, 1999).

The deadline for exercising the right of withdrawal is 10 days from receipt of the goods. By this deadline, the Customer must provide written notice via registered mail with return receipt, addressed to:

P.a.m.co. S.a.s. di Marmorini Roberto & C.
Zona Industriale Manciano 49/L
52043-Castiglion Fiorentino (AR) – ITA

Alternatively, within the same 10-day period following receipt of the goods, a telegram, email, or fax may be sent, provided that the intention to withdraw is confirmed via registered mail with return receipt within the following 48 (forty-eight) hours. This letter must contain:

- a statement of the intention to exercise the rights granted by law;

- details of the product in question;

- the invoice number (if applicable) or, failing that, the waybill number;

- details of the customer's bank or postal current account. For bank accounts, please also include the IBAN and BIC codes.

To exercise the right of withdrawal, the Customer must:

- express the intention to exercise the right of withdrawal in the manner indicated above;

- ensure that the purchased item is intact and returned in its original packaging. Naturally, it must be complete with all its parts. It is not possible to exercise the right of withdrawal for only a part of the product; - return the goods within the timeframes and in the manner described above. Shipping costs are to be borne by the Customer.

Upon receipt, the goods will be inspected for any damage or tampering not attributable to transport.

After verifying the condition of the goods, we will refund the amount previously paid via bank transfer or postal account deposit to the account details you previously provided.

The refund covers only the price of the items and excludes initial shipping costs and transaction fees.

The refund will be processed within 30 days of receipt of the goods for which the right of withdrawal is being exercised.

Costs associated with returning the product are to be borne by the Customer.

The right of withdrawal is forfeited entirely if the essential condition of the product's integrity (packaging and/or contents) is not met—specifically, if P.a.m.co. S.a.s. identifies: the absence of the outer packaging and/or original inner packaging; missing integral components of the product; or damage to the product caused by factors other than transport.

In the event of forfeiture of the right of withdrawal, P.a.m.co. S.a.s. will return the purchased item to the customer and charge the customer for the shipping costs.

Please note: the right of withdrawal, as defined by Legislative Decree no. 185/99, does not apply to the supply of custom-made or personalized products.
